Will I Have To Pay My Spouse’s Student Loans As Part Of Our Divorce In Queens?

March 27, 2016 by Marc Jacob

Student loans sometimes factor into a divorce, and sometimes don’t.

If the loans were accrued during the marriage and were used to pay household bills or otherwise support both parties, then that portion of them may be subject to distribution.

That means that you may end up having to pay some part of your spouse’s student loans.

If your spouse came into the marriage with student loan debt, you should be safe from having it assigned to you, though you may end up contributing more to a spouse with heavy loan debt.

All of these issues have to be carefully worked through to protect your financial standing and keep you from overpaying in the divorce.

The attorneys at Zelenitz, Shapiro & D’Agostino are one of the most experienced divorce teams in Queens, and we help our clients win favorable settlements in even complex divorces.
