What Does It Mean To Have An Uncontested Divorce?

In an uncontested divorce, you and your spouse are able to come to terms for a settlement offer and your spouse agrees to the divorce.

This may be by participating (but not obstructing) the divorce process, or your spouse may agree to the divorce by simply failing to respond when served with notice of the divorce.

Uncontested doesn’t mean that you get to decide the terms.

When you and your spouse decide to end your marriage, the court requires that you agree to a division of your marital assets, work through any support matters, child custody, and resolve your financial dispositions.

The court will not issue a divorce decree until these matters are written into a settlement agreement.
