Is There A Waiting Period Before I Can File For Divorce In Queens, NY?

New York doesn’t require a waiting period before you’re able to file for divorce, but some grounds will require waiting a particular length of time.

For instance, if you file for divorce alleging abandonment, you’ll have to wait at least one year from the time of the abandonment before you can file.

Similarly, filing on grounds of spousal imprisonment, you’ll have to show that your spouse was imprisoned for the last three consecutive years.

Now that New York allows no-fault divorce, you can dispense with these time tables if you prefer.
