My Spouse Has Moved And Filed For Divorce In A Different State. Do I Need A Lawyer There, Or In Queens?

October 15, 2015 by Marc Jacob

If you’ve been served with notice of a divorce filing in another state, assuming that your spouse meets residency and other requirements in that jurisdiction, you’ll need an attorney there.

The good news is that as a New York resident, the other state’s court is limited in what it can order you to do, so your spouse is unlikely to win things like property distribution or spousal maintenance.

Child support is a valid concern, but if you’ve lived apart for a long time, it’s likely you’ve already worked out a system if you have children.

If you prefer the matter be handled in Queens, you may have options for changing the venue.

One of the more common issues is that your spouse doesn’t yet meet the other state’s residency requirements, and jurisdiction can be challenged on those grounds.

The attorneys at Zelenitz, Shapiro & D’Agostino can evaluate your case for you and help you figure out the best way forward.

Call us today at 718-523-1111 and speak to an experienced Queens divorce attorney for free.
