Does The Judge Decide Whether Our Settlement Is Acceptable?

Typically if both parties have participated fully in a divorce action, the judge accepts the settlement that the sides negotiate. In the case of a default divorce or where a spouse is not represented, the judge has more discretion in deciding whether or not a settlement agreement is appropriate.

If your divorce is contested and ultimately goes to trial, then the judge has a great deal of discretion in how your final settlement is handled, and in those situations spouses are often surprised to see that their assets are liquidated for pennies on the dollar.

It’s much better for everyone to do your best to put aside your feelings and negotiate a settlement.
