No, even if you’re the leaseholder on your home, you don’t have the right to simply lock your spouse out, and you can face serious complications in your divorce if you try.

The only terms under which you can unilaterally remove your spouse from the marital home are if there are court orders authorizing it, and those are only issued in cases where domestic violence can be substantiated.

It may be uncomfortable to share a home with a spouse you’re divorcing, but for the time being, you need to retain the status quo.

Your spouse will eventually leave the residence, but for now you should work closely with your attorney to establish the best way forward.
