While New York used to have a number of barriers to divorce, as of 2010, those walls have fallen.

Today, instead of needing a one-year separation to file for divorce, you can file at any time under the Irretrievable Breakdown ground.

This is New York’s version of no-fault divorce, and allows you to attest that your relationship has been irretrievably broken for a period of at least six months.

You don’t have to make a case based on fault or prove misconduct by your spouse, and you can obtain a divorce unilaterally, even if your spouse objects.
