How Long Do I Have To Be Abandoned Before I Can File For Divorce In Queens?

If you wish to file for divorce on the Abandonment ground, then your spouse must be absent for 12 months before you can file.

However, New York’s no-fault grounds, Irretrievable Breakdown, does not require this type of waiting period, or even for your spouse to have abandoned you.

If your marriage has been broken for at least six months and you want a divorce, then under Irretrievable Breakdown, you can obtain a divorce even if your spouse chooses not to participate in the proceedings.

In most cases, it will be easier and less expensive to file for divorce using Irretrievable Breakdown in Queens.

Instead of building a case showing wrongdoing, you’ll only have to attest that your marriage has been irretrievably broken for at least six months to proceed.
