Are There Guidelines For Who Keeps The House In Our Queens Divorce?

October 9, 2014 by Marc Jacob

There aren’t statutory guidelines, and in a contested matter where the parties can’t agree on what to do about what is usually one of the biggest assets in a marriage, judges will often order it to be liquidated with the profits divided.

If you have other ideas for how to handle the house, it’s important that you are willing to negotiate with your spouse to find some areas of common ground.

There are a number of options available to you, from keeping the home until any children have graduated high school and then selling, to buying out your spouse using a loan, to retaining the property as a rental. It really depends on the two of you.

The attorneys at Zelenitz, Shapiro & D’Agostino can help you negotiate with your spouse by presenting the widest range of possible solutions, understanding your goals, and working to achieve them.
