Does It Count As Visitation If My Ex Is At Work In Queens And Their New Spouse Is With My Kids All Day?

December 8, 2014 by Marc Jacob

Yes, if your former spouse has remarried and your kids are home with their stepparent while their parent is at work, that’s still part of visitation.

From a practical standpoint, collecting your kids from an overnight in order to keep them from spending time with a stepparent, then returning them when your ex is done at work would be unduly burdensome for most divorced parents.

And more specifically, your former spouse has a right to help the children form bonds with a new spouse.

If you feel that your first right of refusal trumps this, or if you believe your children are in danger in any way during visitation, you can seek help from a judge.
