Can The Judge Order My Mortgage Company To Approve A Refinance So I Can Retain Our Home In Queens?

August 6, 2015 by Marc Jacob

Unfortunately, no, the judge in your divorce case cannot order the mortgage company to approve your application to refinance your home.

Many people find themselves in situations where their credit isn’t adequate to refinance their marital home into their own name, removing their spouse from the obligation.

This is generally a term of the divorce settlement, and a failure to refinance can result in your ex-spouse taking action to have the home sold.

If your divorce is still ongoing, you may have other options that can change your financial picture enough to get the refi approved.

If your goal is maintaining the home, you have to be able to negotiate terms that will make that possible.

At Zelenitz, Shapiro & D’Agostino, our attorneys know the ins and outs of divorce rules and procedure, and also the difficult position that the current housing market can put people in.

We can help you get what you want from your divorce.

Call us today at 718-523-1111 for a free consultation with an experienced Queens divorce lawyer.
