Can I Use The Appeals Process To Invalidate My Divorce In Queens?

While it is theoretically possible to challenge a judge’s rulings by appealing your divorce judgment, the rules that govern the appeals process mean that it is highly unlikely that such an action would succeed.

Even if an appeals court found that some element of fact had been improperly decided by the judge, there’s not necessarily any reason to believe that they would throw out the entire divorce, which would result in you and your spouse being legally married again.

An appeals court would take issue with creating that level of uncertainty for your former spouse.

There are instances where judges make mistakes, or there is an overwhelming appearance of impropriety that might be cause for an appeal.

If you believe that your case was handled in a way that a higher court would find suspect, you have a short window of time in which to file an appeal.
