Yes, child custody, visitation, and support issues can – in fact, must – be decided as part of your divorce.

If your divorce is uncontested and you and your spouse can negotiate these issues and develop a plan you can both abide by, the court will likely accept your resolution.

If you can’t reach a negotiated resolution, the court will make a ruling on these issues.

If you are already divorced and you or your ex-spouse are failing to meet the terms of your custody, support, or visitation agreements, then you may need to request aid from New York Family Court.
