Is My Spouse’s Adultery Enough To Get A Divorce Approved In Queens?

While adultery is a valid ground for divorce in New York, using any ground other than Irretrievable Breakdown adds to your costs, your burden of proof, and ultimately to your chance of having the divorce denied.

New York was the last state in the nation to adopt a no-fault divorce option, and prior to that couples would have to go to great lengths to obtain a divorce.

The standards of proof are high, and judges often had no choice but to deny a divorce even when two people desperately wanted to end a marriage and move on with their lives.

Under the no-fault option, called Irretrievable Breakdown, the standard is simply whether the marriage has been irretrievably broken for a period of six months or more, as proven by one spouse’s affidavit stating so.

No-fault divorces are cheaper, easier, and have the potential to be faster than a divorce filed on a ground like adultery.
